Mystic Moon Hosting - Acceptable Use Policy (AUP) Basics | Renting/Reselling Space | Add-ons, Parked & Subs | Domain Registration | Privacy | Reporting Abuse | Cancellations & late Payments | Back-Up's | Torturous Conduct Use of Mystic Moon Hosting Service constitutes acceptance and agreement to Mystic Moon Hosting’s AUP as well as Mystic Moon Hosting's TOS (Terms of Service) Mystic Moon Hosting reserves the right to revise, amend, or modify this AUP, my TOS (Terms of Service) and my other policies and agreements at any time and in any manner. Notice of any revision, amendment, or modification will be posted in accordance with my TOS (Terms of Service). All users of Mystic Moon Hosting’s Internet services, and their clients, must comply with this AUP and my TOS (Terms of Service). *All Payments To Mystic Moon Hosting Are Non-Refundable* I support the uncensored flow of information and ideas over the Internet and do not actively monitor subscriber activity under normal circumstances. Similarly, I do not exercise editorial control over the content of any web site, e-mail transmission, newsgroups, or other material created or accessible over or through the services, except for certain proprietary Web sites. However, in accordance with my TOS (Terms of Service), I may remove any materials that, in my sole discretion, may be illegal, may subject me to liability, or which may violate this AUP. Mystic Moon Hosting may cooperate with legal authorities and/or third parties in the investigation of any suspected or alleged crime or civil wrongdoing. Your violation of this AUP may result in the suspension or immediate termination of either your Mystic Moon Hosting account or other actions as detailed below without notice, based upon the nature of the violation. This document is intended to provide a basic understanding of Mystic Moon Hosting's Acceptable Use Policy. The following are guidelines for the establishment and enforcement of Mystic Moon Hosting's AUP. If a Mystic Moon Hosting™ account violates this Acceptable Use Policy or my TOS, I reserve the right to terminate your service without notice. I prefer to advise customers of inappropriate behavior and any necessary corrective action, however based on the nature of the violation, could result in immediate termination of service. The following constitute violations of this AUP: · Illegal Activities: Mystic Moon Hosting's services may not be used for illegal purposes, or in support of illegal activities. Mystic Moon Hosting reserves the right to cooperate with legal authorities and/or injured third parties in the investigation of any suspected crime or civil wrongdoing. · Harm or Endangerment to other people: You may not use Mystic Moon Hosting’s service to harm, or attempt to harm, minors in any way, including, but not limited to child pornography, or use Mystic Moon Hosting’s service to transmit any material (by e-mail, uploading, posting or otherwise) that threatens or encourages bodily harm or destruction of property. · Forgery or impersonation: Adding, removing or modifying identifying network header information in an effort to deceive or mislead is prohibited. Attempting to impersonate any person by using forged headers or other identifying information is prohibited. The use of anonymous remailers or nicknames does not constitute impersonation. · Unsolicited E-mail, News Bombing (SPAM) : Use of the Mystic Moon Hosting service to transmit any unsolicited commercial or unsolicited bulk e-mail is expressly prohibited. Violations of this type will result in the immediate termination of the offending Mystic Moon Hosting account. Malicious intent to impede another person's use of electronic mail services or news will result in the immediate termination of the offending Mystic Moon Hosting account. · Copyright or trademark infringement: Use of the Mystic Moon Hosting service to transmit any material (by e-mail, uploading, posting or otherwise) that infringes any copyright, trademark, patent, trade secret or other proprietary rights of any third party, including, but not limited to, the unauthorized copying of copyrighted material, the digitization and distribution of photographs from magazines, books, or other copyrighted sources, and the unauthorized transmittal of copyrighted software. Use of the Mystic Moon Hosting service to collect, or attempt to collect, personal information about third parties without their knowledge or consent. Distribution and/or posting of copyrighted or the aforementioned infringements will not be tolerated. · Network disruptions : Use of the Mystic Moon Hosting service for any activity which affects the ability of other people or systems to use Mystic Moon Hosting Services or the Internet. This includes "denial of service" (DOS) attacks against another network host or individual user. Interference with or disruption of other network users, services or equipment is prohibited. Mystic Moon Hosting will not tolerate any subscriber attempting to access the accounts of others, or penetrate security measures of other systems, whether or not the intrusion results in corruption or loss of data. Mystic Moon Hosting, does not allow the hosting of IRC, IRC Bots, or eggdrops on my servers. Accounts found hosting this material will be subject to immediate cancellation without refund. Use of the Mystic Moon Hosting service to access, or to attempt to access, the accounts of others, or to penetrate, or attempt to penetrate, security measures of Mystic Moon Hosting's or another entity's computer software or hardware, electronic communications system, or telecommunications system, whether or not the intrusion results in the corruption or loss of data, is expressly prohibited and the offending Mystic Moon Hosting account is subject to immediate termination. · Security: You are responsible for any misuse of your account, even if the inappropriate activity was committed by a friend, family member, guest or employee. Therefore, you must take steps to ensure that others do not gain unauthorized access to your account. In addition, you may not use your account to breach security of another account or attempt to gain unauthorized access to another network or server. · Network Security: Mystic Moon Hosting accounts operate on shared network resources. Excessive use or abuse of these resources by one customer may have a negative impact on all other customers. Misuse of network resources in a manner which impairs network performance is prohibited by this policy and may result in termination of your account. Back to top · Reselling / Renting Server Space: Webhosting space is clients personal/business website use solely and my hosting services can not be resold, rented or redistributed to a third party in any way for any reason whatsoever. Back to top · About Add-Ons, Parked & Sub domains : Add-On, Parked & Sub domains are for your personal use only. not to offer hosting whether free or paid to others. (see above about reselling/renting space) By personal use, this means your own purchased domain names, domain names purchased by or for family members residing in the same household as you and sub-domains created for you or household members use only. I'm sorry but with how much I give & such a cheap price it is not fair to me or the other hostees who do not do this. I do not have any plans of offering full Reseller packages. Something else is in the works though & current hostee will be informed of this once it's implemented. Back to top · Domain Registration : No refunds whatsoever can be given after the registration of a domain name even if you decide afterwards that you no longer wish to register that domain. If the request to register your domain name has not yet been fulfilled by Mystic Moon Hosting you have a right to cancel that request. Back to top · Privacy : I will not release any confidential information about you without your consent or as required by law or regulatory authority. You acknowledge that some of your contact information will be attached to your domain(s) and will therefore become publicly available. Back to top REPORTING VIOLATIONS OF Mystic Moon Hosting AUP Mystic Moon Hosting™ requests that anyone who believes that there is a violation of this AUP direct the information to the Abuse Department by using the "Contact Me" form to the left if possible, please provide the IP address used to commit the violation, date and time of the violation, and evidence of the violation. Back to top ~ Cancellations, Late Payments ~ · Cancellation : - In the event you cancel your acct, you will be charged in full for the entire month in which you canceled your service. You must cancel your acct by emailing me or via the bill center at least 5 days before the acct becomes due again and/or before paypal auto pays. It is your responsibility to cancel any active paypal subscriptions, failure to do so will result in paypal continuing to pay on your behalf & no refund will be issued for those additional payments. If a refund is owed to you, they are only given via paypal.com In the event there is a server crash, no refunds or credits will be issued. A server crash is equivalent to a natural diaster, we have no control over them, therefore are not held responsible. In the event of a server crash, all back ups will be gone, it is & always been the customers responsibility to perform their own back-ups via cPanel. The daily, weekly & monthly back ups provided by the server are for convenience only. Account cancellations for accounts with a negative balance will be passed on to collections, and all services rendered to the party with the negative balance will be terminated, including domain registrations. There is a $50 administrative fee for any illegitimate charge backs placed against me. Any illegitimate charge backs or threatened illegitimate charge backs are grounds for immediate account cancellation. If you lie, threatened, are disrespectful to me at anytime, you are forfeiting your right to any refund · Late Payment Chain of Events: 5 days late site is suspended, site will be unsuspended upon successful payment 30 days late site is terminated, site can be brought back through a back-up once late payment, plus $15.00 reactivation fee & current month payment is made. 60 days late the only way to get your site back is by paying the late fees, plus $15.00 reactivation fee & prepaid 6 or 12 months of service. A back-up /restore may no longer be available. If you are late 3 times in a row, you will incur late fees equaling $10.00 for every month there-after and may be required to prepaid for longer pay terms Back to top . Torturous Conduct: Any case of indecent treatment towards Mystic Moon Hosting will be considered inappropriate. Each Customer is anticipated to conduct a professionally mannered communication with Mystic Moon Hosting™ regarding any requests for help through e-mail or by means of the Support System. Each Customer should avoid applying any forms of written emotional outburst or cursing. Any attempts of deliberately undermining behavior will be interpreted as a breach of this TOS. THIS KIND OF BEHAVIOR WILL NOT BE TOLERATED! Other acts of treatment towards Mystic Moon Hosting that will be considered as unacceptable include any verbal, oral, written or delivered by a second party threats addressing Mystic Moon Hosting or any of its employees, partners, equipment, and concerns. Any forms of such threats will be interpreted as a breach of this TOS. Mystic Moon Hosting keeps the right to assess which behavior will be treated as a breach of this TOS and to give no refunds to the users whose accounts have been suspended for violating the aforementioned rules Back to top . Back-Ups: Back-ups are the hostee's responsibility. The server does do a daily, weekly & monthly back-up, however, this is & never has been a guarantee. There is now monthly backups to another server in a different datacenter, but still no guarantee - please still keep your own backups To learn how to do your own back-up's, log in your cPanel > Tut Center > back-ups Back to top I reserve the right, at my discretion, to change, modify, add, or remove portions of these terms at any time.
